Preamble
These Terms and Conditions of Sale (hereinafter “TCS”) govern the sale of original artworks made directly between the Artist and the Buyer. Any order implies full and unconditional acceptance of these TCS.
Article 1 – Order and conclusion of the sale
The artworks are presented with their essential characteristics, price, and, where applicable, their size and technique. The Buyer selects the artwork of their choice and confirms the order after reading and accepting these TCS. The sale contract is deemed concluded once payment has been validated and the Artist has confirmed the availability of the artwork.
Article 2 – Price
Prices are indicated in euros, all taxes included (TTC). They are valid at the time of the order and may be modified without notice for artworks not yet sold. Worldwide shipping is free of charge, unless otherwise specified before the order.
Article 3 – Payment
Payment can be made by bank transfer directly to the Artist’s account, or by any other payment method indicated at the time of the order. The order is considered final only after full receipt of the payment.
Article 4 – Delivery
The artworks are shipped by the Artist within approximately 5 to 10 business days after payment has been received, unless otherwise stated. Each piece is carefully packaged and shipped to the address provided by the Buyer. Worldwide delivery is free of charge. However, additional delays may occur due to customs procedures depending on the destination country.
Article 5 – Customs duties and taxes
Even though delivery is free, any customs duties, local taxes, or import fees required by the destination country’s authorities are the exclusive responsibility of the Buyer. The Buyer is solely responsible for all declarations and payments to their local customs authorities. The Artist cannot be held responsible for these fees or for any delays caused by customs services.
Article 6 – Right of withdrawal
In accordance with applicable law, any individual Buyer residing within the European Union has a period of 14 days from the receipt of the artwork to exercise their right of withdrawal, without justification or penalty. The Buyer must inform the Artist of their decision by e-mail or postal mail. The artwork must be returned in its original packaging, in perfect condition. Return shipping costs are borne by the Buyer. A refund will be issued within a maximum of 14 days after the returned artwork is received.
Article 7 – Reception and claims
The Buyer must check the condition of the package upon delivery and report any visible damage to the carrier. Any claim concerning the condition of the artwork must be made to the Artist within 48 hours of delivery. After this period, the artwork will be considered accepted as delivered.
Article 8 – Personal data
The information collected during the order process is necessary for processing and delivering the artwork. It remains strictly confidential and is used solely for administrative or accounting purposes. In accordance with the GDPR, the Buyer may at any time request the correction or deletion of their personal data.
Article 9 – Intellectual property
The purchase of an artwork does not include any transfer of copyright. The Buyer acquires only the physical medium of the artwork. Any reproduction, representation, or exploitation of the artwork without the written consent of the Artist is strictly prohibited. The Artist retains all moral rights over the artwork, including the right to the integrity of their work and attribution of authorship.
Article 10 – Applicable law and disputes
These TCS are governed by French law. In the event of a dispute, both parties will seek an amicable resolution. Failing that, the competent courts of France shall have exclusive jurisdiction.
